Firm Overview
Rich Fogel has defended litigation claims involving lead paint, mold, asbestos, benzene, ink, and other toxic tort and environmental claims as well as related insurance coverage disputes and disputes between insurance companies for more than three decades in the Greater New York City in state and federal courts including the Appellate Division-Second and First Departments as well as the Second Circuit Court of Appeals and the New York Court of Appeals. Mr. Fogel also routinely litigates commercial and contractual claims as well as shareholder and partnership disputes. The Law Offices of Richard A. Fogel, P.C. is a litigation law firm that concentrates its practice on insurance coverage, toxic torts, environmental, product liability and commercial litigation. In particular, the firm represents landlords, manufacturers, distributors, retailers, waste haulers and dry cleaners, and other small businesses. The firm also defends insured businesses for insurance companies. Rich Fogel also served as outside general counsel for a retailer.
Mr. Fogel holds a Master’s Degree in Environmental Science so he has a unique ability to work with experts such as toxicologists, environmental and mechanical engineers and of course medical doctors on scientific issues and communicate complex causation and technical explanations to courts and juries. When it comes to claims arising out of lead paint, asbestos, mold, dry-cleaning fluid (perchlorethylene (Perc) (PCE)), petroleum products (benzene, xylene, toluene, diesel, heating oil), leaking underground storage tanks (LUST), industrial chemicals such as polyvinyl chloride (PVC), ketone (ink), degreasers (trichloroethylene (TCE), trychloroethane (TCA)), solvents (acetone, turpentine), PCBs (polychlorinated biphenyl), tar, insulation fibers, or other environmental contamination, toxic chemicals, or product liability claims arising out of allegedly toxic products or complex medical devices, and related insurance coverage disputes, the firm is uniquely qualified to achieve the most cost effective resolution.
The firm’s practice is ninety percent repeat business because its focus is on getting the matter resolved on a basis that serves the client’s best interests. This is not a volume practice unlike many insurance defense firms. The practice is designed for personal service for technical cases without incurring the premium price demanded by larger firms. Mr. Fogel has been practicing since 1987 and has been a partner at large firms. In 2004, he decided to open his own boutique firm to better serve his longstanding clients and control overhead costs so rates remain very competitive. The firm appears in all courts located in the Greater New York City area, including Northern New Jersey. Job One at the firm is to resolve litigation cost effectively. Rich Fogel is a “Bests Recommended Insurance Counsel”, rated “AV” for ethical standards and legal ability by LexisNexis/Martindale Hubbell and a nominated member of the Claims and Litigation Management Alliance. When you retain the Law Offices of Richard A. Fogel, P.C., Rich Fogel personally handles all aspects of your matter at all stages of the case including inception, pleadings, discovery, trial and appeal; not some junior attorney/recent law school graduate. As a result the client is not required to hire and pay another lawyer if an appeal is involved or to pay for additional attorneys to handle different stages of the same case. We believe that it is more sensible and cost effective to have one attorney handle the entire case from start to finish so that additional lawyers don’t have to re-learn the facts and law of the case. If the same lawyer was at the deposition of the witness, he is far better equipped to orally argue a motion or appeal before the court that arises out of the deposition testimony and of course to try the case. The Law Offices of Richard A. Fogel, P.C. possesses a distinct ability to advise its clients on the true nature and worth of their claim. This is important when it comes to knowing when to settle a case rather than taking it to trial or appeal. Our philosophy is to get the best resolution for our clients. This saves clients time, money, and years of litigation headaches. Over the years, we have earned the trust and respect of major insurance companies and large and small businesses. We are proud of the fact that most of our business is repeat business and referrals from satisfied clients.
